Terms & Conditions

Effective date: 11 August 2026 | Version 2.0
 

These Terms & Conditions govern your use of the Viva Sports website (vivasports.cz), your registration for leagues, events, and other activities, and your participation in any Viva Sports programme. By registering or using our services, you agree to these terms in full. Please read them carefully before signing up.

Purchases made through our online shop are governed by the separate Viva Sports E-Shop Terms & Conditions, described in Section 13 below.

References to “Viva Sports”, “we”, “us”, and “our” throughout these Terms refer to Viva Play Prague s.r.o.
 

2. Acceptance of Terms

By accessing vivasports.cz, creating an account on our player portal, or registering for any league, event, training session, open play, or tournament, you confirm that:

  • You have read, understood, and agree to these Terms & Conditions in full

  • You are at least 18 years of age

  • You have the legal capacity to enter into a binding agreement

  • All information you provide during registration is accurate and complete
     

If you do not agree to these terms, you must not use our services. Viva Sports reserves the right to update these Terms at any time. Continued use of our services after an update constitutes acceptance of the revised terms.
 

3. Eligibility

Viva Sports welcomes all adults aged 18 and over. We are open to everyone regardless of race, colour, sex, national origin, religion, sexual orientation, or gender identity and expression.
 

By registering, you confirm you are medically fit to participate in the physical activity you have signed up for. If you have any medical condition, injury, or concern that could affect your participation, you are responsible for seeking appropriate medical advice before taking part.
 

4. Registration and Accounts

4.1 How to register

All registrations must be completed online through our website (vivasports.cz) or player portal (playerportal-vivasports.squadfusion.com). We do not accept registrations by phone, email, or on-site.


4.2 Account responsibility

When you create an account on the player portal, you are responsible for keeping your login credentials secure and confidential, for all activity that occurs under your account, and for notifying us immediately at info@vivasports.cz if you suspect unauthorised access. Viva Sports is not liable for any loss resulting from unauthorised use of your account.


4.3 Registration types

Individual: You will be placed on a team with other individuals or small groups. You will remain on that team for the duration of the league. No refund is available if you are not satisfied with your team placement.


Team: Your full team registers together. If your team does not meet the minimum player count, additional individuals may be added to complete your roster. If your team meets the minimum, no additional players will be added.


Small group: Groups that do not meet the full team requirement may be joined with other small groups or individuals. No refund is available if you are not satisfied with the additional players assigned to your group.


4.4 Player portal powered by SquadFusion

Our player portal is powered by SquadFusion Inc. By creating an account and registering through the portal, you are also subject to SquadFusion’s Terms of Use (squadfusion.com/tou) and Privacy Policy (squadfusion.com/privacy). The player portal is owned and operated on behalf of Viva Sports.

5. Fees and Payment

5.1 Fee structure

  • Sport leagues: a one-time flat fee covering the full duration of the league season.

  • Open play and training sessions: pay per session, only for the sessions you attend.

  • Tournaments: a one-time flat fee covering the full tournament.

  • Events: pricing is set per event and displayed at the point of registration.
     

5.2 Payment processing

All payments are processed securely by Stripe Inc. via the player portal. By completing payment you agree to Stripe’s terms of service. Viva Sports does not store any payment card data. Payments are confirmed by email from the portal.


5.3 Early bird pricing

Where early bird pricing is offered, it applies only for the period stated on the event or league registration page. Standard pricing applies after that date. Early bird rates cannot be applied retrospectively.


5.4 Price changes

Viva Sports reserves the right to update pricing for future seasons or events. Existing confirmed registrations will not be affected by price changes after the point of registration.
 

6. Cancellation & Refund Policy

Viva Sports understands that plans can change. This policy is designed to be fair to participants while allowing us to cover venue, staffing, and event costs, and it applies to all Sport Leagues, Open Play, Training Sessions, Tournaments, and Special Events booked through vivasports.cz or the player portal.
 

6.1 Individual sessions and open play

  • Cancellation 24 or more hours before the scheduled start time: full refund or account credit, your choice

  • Cancellation less than 24 hours before the scheduled start time: no refund

  • No-show: no refund


Viva Sports may, at its discretion, offer an account credit for late cancellations in appropriate cases.


6.2 Leagues

League registrations reserve a place for the full league period.

  • Cancellation before the league registration deadline: full refund, subject to any specific conditions stated on the relevant league registration page

  • Cancellation after the registration deadline but before the league start date: no refund normally provided; Viva Sports may, at its discretion, offer credit or allow the registration to be transferred to another eligible player

  • Cancellation after the league has started: no refund normally provided for missed games, including where this is due to personal circumstances, work or study changes, relocation, or injury. See Section 6.6, which applies to injury and personal circumstances across all activity types.


6.3 Tournaments and special events


Unless otherwise stated on the individual event registration page:

  • Cancellation 7 or more days before the event: full refund or account credit

  • Cancellation less than 7 days before the event: no refund

  • No-show: no refund


Participants may request to transfer their place to another eligible participant, subject to Viva Sports’ approval and any event-specific rules.


6.4 Event cancellation or rescheduling by Viva Sports

If Viva Sports cancels an event, or is unable to provide a booked activity due to insufficient player numbers, venue issues, or other operational reasons, we will notify registered participants as soon as reasonably possible. Where the event can reasonably be rescheduled, we will offer a place at the rescheduled event or an equivalent account credit. Where it cannot reasonably be rescheduled, we will provide an appropriate refund or credit.


6.5 Weather and venue issues

Outdoor activities may be affected by weather, venue availability, or other circumstances outside Viva Sports’ reasonable control. We will make reasonable efforts to provide a replacement session, reschedule the activity, or provide an appropriate credit or refund where the activity cannot be provided. Weather-related decisions are made by Viva Sports, in cooperation with the relevant venue where appropriate.


6.6 Injury and personal circumstances

Once a participant has registered for a league, tournament, session, or event, refunds are not automatically provided where a participant cannot take part because of injury, illness, work or study commitments, relocation, travel, or other changes in personal circumstances. This reflects the statutory basis described in Section 6.8.

However, if you cannot continue due to injury, illness, or another serious personal circumstance, you may contact us at info@vivasports.cz to request an account credit or a registration transfer. Requests are considered individually and are not guaranteed, but we aim to find a reasonable solution wherever we can, in particular for injuries sustained while participating in a Viva Sports activity. This section applies across all activity types covered by this policy, not only leagues.


6.7 Transfers

Where permitted for a particular activity, a participant may request to transfer their place to another eligible person. Transfers must be approved by Viva Sports in advance. Viva Sports may refuse a transfer where it would create operational, safety, or eligibility issues.


6.8 Legal basis and statutory rights

Nothing in this policy limits or excludes any mandatory right that consumers have under Czech or EU law. Where a statutory consumer right applies, that right takes precedence over the rules set out in this policy.

This Cancellation & Refund Policy is structured on the basis of Section 1837(j) of the Czech Civil Code (Act No. 89/2012 Coll.), under which the standard 14-day statutory right to withdraw from a distance contract does not apply to contracts for the use of leisure time where performance is to take place on a specific date or within a specific period. Where a particular activity does not meet this description, the standard withdrawal right applies to that activity instead.


6.9 Credits

All credits issued by Viva Sports are valid for 12 months from the date of issue. Credits are non-transferable, have no cash value, and can only be applied to future Viva Sports events, sessions, or leagues. Any unused credit will expire automatically after 12 months.


6.10 How to cancel

To request a cancellation, contact Viva Sports at info@vivasports.cz or through the registration platform used for the relevant activity. The time at which the cancellation request is received determines which cancellation terms apply. Cancellations cannot be processed on-site or by phone.
 

7. Schedules, Games, and Formats

7.1 Schedules

Game schedules are sent by email after registration and are available in the player portal under League Games, Dates, and Tables. You are responsible for keeping track of your schedule and attending your games. Viva Sports will send a reminder email one to two days before each game.


7.2 Game times

All games start and end on time. Some leagues may allow a 10-minute warm-up or grace period but the game clock starts at the scheduled time. Once a team has the minimum number of players required, staff may ask the game to begin.


7.3 League format

Leagues are organised by designated day of the week. All games in a given league are played on the same day unless a make-up game requires rescheduling. Leagues are structured by Game Weeks. If a game is cancelled it may be rescheduled to a different day.


7.4 Forfeits

If a team fails to show for a scheduled game, the match is automatically awarded to the team present. Forfeit scores are capped as follows:

  • Beach volleyball: 3-0 in sets

  • Basketball: 40-0

  • Football: 5-0


7.5 Playoffs

The final week of a league season is reserved for playoff matches. If a team does not appear for a final, the team with the higher points total from the group stage will advance or play in their place.


7.6 Substitute players

If you cannot attend a game, you may ask a friend to play as a substitute. A team may use up to three substitutes and one original player and still play. However, if the team does not meet the minimum number of players required to start, the opposing team is awarded the win.


7.7 Weather cancellations

If a game is cancelled due to weather, you will be notified by email before 5 PM on the day of the game. If you have not received a cancellation email by 5 PM, the game is on as scheduled.
 

8. Sportsmanship and Conduct

Viva Sports is committed to a positive, inclusive environment for all players and staff. All participants are expected to play in the spirit of the game and treat others with respect.


8.1 Unacceptable behaviour

Viva Sports staff have the authority to remove any player or spectator and may eject or suspend participants for physical or verbal assault of players, staff, or spectators; unsportsmanlike conduct or persistent unruly behaviour; endangering others through actions on or off the field; using illegal or dangerous equipment; being under the influence of alcohol or drugs; or failure to play in the spirit of the game.


8.2 Suspensions and bans

If a player is ejected for conduct, management will review the situation and determine whether the player is removed from the entire league or season. No refund will be issued for games or sessions missed due to suspension or ban.

Viva Sports honours lengthy suspensions issued by other local sports organisations. If you are serving a suspension from another organisation, it may apply to Viva Sports leagues.

Staff may end a game due to persistent unruly behaviour. These games will not be rescheduled and no refunds will be issued.


8.3 Team responsibility

Teams are responsible for the behaviour of their teammates and spectators. If a teammate or supporter becomes disruptive, the team should manage the situation to prevent further disciplinary action against the team as a whole.
 

9. Injury, Assumption of Risk, and Liability

9.1 Nature of the activities

Viva Sports’ sport leagues, open play, training sessions, tournaments, and other activities are physical activities that, by their nature, involve a risk of injury, including falls, collisions with other participants, and the physical demands of the sport concerned. These risks may exist even where ordinary safety rules are followed and Viva Sports exercises reasonable care.


9.2 Participant responsibility

By registering for an activity, you confirm that you are aware of its physical nature and that you are able to take part safely. You must follow the rules of the activity, the instructions of organisers, and Viva Sports’ safety instructions, and must not needlessly endanger yourself or other participants.

If you have a medical condition, injury, or other circumstance that could affect your ability to participate safely, it is your responsibility to consider whether participation is appropriate and, where necessary, to seek medical advice before taking part.

We recommend that participants arrange appropriate health or accident insurance.


9.3 Viva Sports’ responsibility

Viva Sports takes reasonable care in organising activities, providing suitable facilities, and following appropriate safety procedures.

Viva Sports is not liable for harm arising from the ordinary and foreseeable risks associated with the relevant sporting activity.

Nothing in these Terms excludes or limits Viva Sports’ liability to the extent that such exclusion or limitation is not permitted under applicable law, in particular Section 2898 of the Civil Code (Act No. 89/2012 Coll.).


9.4 Assumption of ordinary risk


By registering, you confirm that you understand the ordinary risks associated with the sporting activity you are taking part in, and that you voluntarily agree to participate with knowledge of those risks.

Accepting these ordinary risks does not mean waiving any rights available to you under applicable law, nor does it exclude Viva Sports’ liability to the extent required by law.
 

10. Intellectual Property

All content on vivasports.cz, including but not limited to text, graphics, logos, images, video, and software, is the property of Viva Play Prague s.r.o. or its licensed partners and is protected under Czech and EU intellectual property law.
 

You may not reproduce, distribute, modify, or create derivative works from any content on our website or player portal without prior written consent from Viva Sports. Personal, non-commercial use for the purpose of participating in our services is permitted.
 

11. Social Media and Photography

Viva Sports may photograph or film events for promotional use on our social media channels and website. Our staff will always seek your explicit consent before capturing or publishing any content in which you are identifiable.

  • If you consent, content may be shared on Instagram, TikTok, Facebook, LinkedIn, and vivasports.cz

  • If you decline, we will not photograph, film, or publish any content featuring you

  • You may withdraw consent for previously published content at any time by contacting info@vivasports.cz


By participating in our events, you acknowledge that other players and spectators may photograph or film activity. Viva Sports is not responsible for content captured and shared by third parties.
 

12. Website and Portal Use

You agree to use vivasports.cz and the player portal only for lawful purposes and in a manner that does not infringe the rights of others. You must not attempt to gain unauthorised access to any part of our website or portal; transmit any harmful, offensive, or disruptive material; use automated tools to scrape, copy, or extract data from our website; or impersonate any person or entity or misrepresent your affiliation with any person or entity.
 

Viva Sports reserves the right to suspend or terminate access for any user who breaches these conditions.
 

13. E-Shop and Online Purchases

Viva Sports operates an online shop at vivasports.cz selling physical products and gift vouchers.

Purchases made through the e-shop, including the ordering process, pricing and payment, delivery, your right of withdrawal, and your rights in the event of faulty or incorrect goods, are governed by our separate E-Shop Terms & Conditions, published at vivasports.cz and available on request from info@vivasports.cz.

The E-Shop Terms & Conditions apply in addition to the general provisions of these Terms & Conditions wherever you make a purchase through the e-shop.
 

14. Limitation of Liability

To the maximum extent permitted by Czech and EU law, Viva Sports shall not be liable for any indirect, incidental, or consequential loss arising from your use of our services; loss of data, loss of revenue, or loss of enjoyment resulting from service interruptions; errors or omissions in schedules, standings, or communications that do not result in material harm; or third-party actions including those of SquadFusion, Stripe, or other service providers.
 

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the specific service to which the claim relates. This limitation does not apply to any liability that cannot be limited under Czech law, including liability for harm to health or life as described in Section 9, or liability for intentional acts or gross negligence.
 

Nothing in these Terms affects your statutory rights as a consumer under Czech law or EU consumer protection legislation.
 

15. Governing Law and Disputes

These Terms & Conditions are governed by and construed in accordance with the laws of the Czech Republic, including the Czech Civil Code (Act No. 89/2012 Coll.) and applicable EU regulations.
 

Any dispute arising from or related to these Terms that cannot be resolved by direct communication with Viva Sports shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.
 

For consumer disputes, you have the right to use out-of-court dispute resolution through the Czech Trade Inspection Authority (ÄŚeská obchodní inspekce, ÄŚOI) at coi.cz. Please note that the European Commission’s former EU Online Dispute Resolution Platform was discontinued on 20 July 2025; a current list of consumer dispute resolution bodies across the EU, Norway, and Iceland is available at consumer-redress.ec.europa.eu/dispute-resolution-bodies.
 

16. Amendments

Viva Sports reserves the right to update or amend these Terms at any time. We will notify registered users of material changes by email and will post the updated Terms on vivasports.cz with a revised effective date. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.
