E-Shop Terms & Conditions

These E-Shop Terms & Conditions (“E-Shop Terms”) govern the purchase of physical products and gift vouchers through the online shop at vivasports.cz (the “E-Shop”), operated by Viva Play Prague s.r.o. They apply in addition to, and alongside, the general Viva Sports Terms & Conditions, which govern registration for leagues, events, and other activities. Where the two documents conflict on a matter specific to a purchase of goods, these E-Shop Terms take precedence for that purchase.

References to “Viva Sports”, “we”, “us”, and “our” throughout these E-Shop Terms refer to Viva Play Prague s.r.o.
 

2. Placing an Order

Orders can be placed only through the E-Shop at vivasports.cz. To place an order: add the product to your basket, complete the checkout form with accurate delivery and contact details, review your order and correct any input errors before submitting it, and confirm the order by completing payment.
 

Submitting a completed order with payment constitutes a binding offer to purchase. The purchase contract between you and Viva Sports is concluded once we confirm your order by email. You will receive an order confirmation at the email address you provided at checkout; we recommend keeping a copy for your records. These E-Shop Terms form part of every purchase contract concluded through the E-Shop.
 

3. Products and Availability

All products are subject to availability. We reserve the right to discontinue any product at any time. Product images are for illustrative purposes only; colours and sizing may vary slightly from what is displayed. For league kit items such as T-shirts, size and colour availability cannot be guaranteed and depends on supplier stock at the time of fulfilment.
 

4. Prices and Payment

All prices are displayed in CZK. Viva Sports is not a registered VAT payer (neplátce DPH), so prices are not subject to VAT and no VAT is added at checkout. Viva Sports reserves the right to update prices at any time; the price charged is the price displayed at the time you complete your purchase. All payments are processed securely by Stripe Inc. We do not store your card data.
 

5. Gift Vouchers

Gift vouchers are valid for 12 months from the date of purchase, have no cash value, and cannot be exchanged for cash. Vouchers can only be redeemed against Viva Sports events, leagues, or products. Lost or stolen vouchers cannot be replaced.
 

6. Delivery

Physical products are dispatched within 5 working days of order confirmation unless otherwise stated. Delivery times and costs are displayed at checkout. Viva Sports is not responsible for delays caused by third-party couriers. Digital products and gift vouchers are delivered by email to the address provided at checkout.
 

7. Right of Withdrawal

Under EU Directive 2011/83 and the Czech Civil Code (Act No. 89/2012 Coll., Section 1829), you have the right to withdraw from a distance purchase of physical goods within 14 days of receiving your order, without giving any reason.

To exercise this right, notify us at info@vivasports.cz within 14 days of receiving your order, including your name, order number, and the item you wish to return. You are responsible for the cost of returning the goods. Items must be returned in their original condition and packaging.
 

The 14-day withdrawal right does not apply to gift vouchers and digital products once delivered by email; personalised or custom-made items; or sealed goods that have been opened after delivery where return is not suitable for hygiene reasons.

This withdrawal right applies only to purchases of goods through the E-Shop. It does not apply to registrations for leagues, sessions, tournaments, or events, which are instead governed by the Cancellation & Refund Policy in the general Viva Sports Terms & Conditions.
 

8. Returns and Refunds

Once we receive and inspect a returned item, we will process your refund within 14 days using the same payment method used for the original purchase.
 

9. Rights from Defective Performance (Complaints)

If you receive an item that is faulty, damaged, or does not match your order, you may exercise your statutory rights under the Czech Civil Code (Sections 2099-2117 and 2165) and the Consumer Protection Act (Act No. 634/1992 Coll.). Consumers have the right to claim for defects that appear within 24 months of receiving consumer goods. For defects that appear within the first 6 months after receipt, the defect is presumed to have existed at the time of delivery unless we prove otherwise.
 

To make a claim (reklamace), contact us at info@vivasports.cz with your order number, a description of the fault, and your preferred resolution (repair, replacement, discount, or refund). We will issue written confirmation of your claim and resolve it without undue delay and no later than 30 days from the date you make the claim, unless we agree a longer period with you. If we do not resolve your claim within this period, you are entitled to treat the defect as one that cannot be remedied and may withdraw from the purchase or request a reasonable discount. Return shipping costs for confirmed faulty or incorrect items are covered by Viva Sports at no charge to you.
 

10. Personal Data

Your personal data is processed in accordance with the Viva Sports Privacy & Cookie Policy, available at vivasports.cz. This includes data collected during the ordering, payment, and delivery process.
 

11. Liability

To the maximum extent permitted by Czech and EU law, Viva Sports is not liable for indirect or consequential loss arising from a purchase made through the E-Shop. This does not affect your statutory rights, including your rights from defective performance described in Section 9, or any liability that cannot be limited under Czech law.
 

12. Governing Law and Disputes

These E-Shop Terms are governed by and construed in accordance with the laws of the Czech Republic, including the Czech Civil Code (Act No. 89/2012 Coll.) and applicable EU regulations.
 

Any dispute arising from a purchase made through the E-Shop that cannot be resolved by direct communication with Viva Sports shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.
 

For consumer disputes, you have the right to use out-of-court dispute resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI) at coi.cz. Please note that the European Commission’s former EU Online Dispute Resolution Platform was discontinued on 20 July 2025; a current list of consumer dispute resolution bodies across the EU, Norway, and Iceland is available at consumer-redress.ec.europa.eu/dispute-resolution-bodies.
 

13. Final Provisions

Viva Sports may amend these E-Shop Terms from time to time. The version in effect at the time you place an order applies to that order. The current version is always available at vivasports.cz and can be provided on request at info@vivasports.cz.

Nothing in these E-Shop Terms affects your statutory rights as a consumer under Czech law or EU consumer protection legislation.
